  1. PRIVACY POLICY

     

    Information Collection and Use

    MPTours S.A. is the sole owner of the information collected on this Web site. We will not sell, share, or rent this information to others in ways different from what is disclosed in this statement. MPTours collects information from its users at several different points on its Web site.

     

    Registration

    In order to use this website, a user must first complete the registration form. During registration a user is required to give their contact information (name and email address) and to create a username & password. This information is used to contact the user about the services on our site for which they have expressed interest. MPTours does not require the user to provide demographic information, such as income level and gender, nor unique identifiers such as personal identity or social security numbers.

     

    Order

    We request information from the user on our order form. Here a user must provide contact information (i.e., name, email, telephone and other relevant contact information). Financial information (i.e., credit card number, expiration date, etc.) is used solely for billing purposes and to fill customer's orders and shall only be requested by, and made available by you to, our providers of electronic payment services (currently, PayPal and 2Checkout). For more information on how financial information is handled by our providers of electronic payment, please refer to their respective Web sites (www.paypal.com and www.2checkout.com). If we have trouble processing an order, this contact information is used to get in touch with the user.

     

    Cookies

    A cookie is a piece of data stored on the user's hard drive containing information about the user. Usage of a cookie is in no way linked to any personally identifiable information while on our Web site. For instance, by setting a cookie on our Web site, the user would not have to log in a password, thereby saving time each time they visit our site. Should the user want to temporarily disable this function they can do so by clicking the log-out link. If a user rejects the cookie, they may still use our site. The only drawback to this is that the user will be limited in some areas of our site. For example, the user will not be able to participate in any of our contests or special offers that take place.     We use IP addresses to analyze trends, administer the site, track user's movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information.

     

    Sharing

    We do not share information about individuals with anyone other than the credit card processors.

    Surveys & Contests

    From time-to-time our site may request information from users via surveys or contests. Participation in these surveys or contests is completely voluntary and the user therefore has a choice whether or not to disclose this information. Information requested may include contact information (such as name, email and address), and demographic information (such as zip code, age level). Contact information will be used to notify the winners and award prizes. Survey information will be used for purposes of monitoring or improving use of and satisfaction with this Web site.

     

    Security

    This Web site takes every precaution to protect its users' information. When users submit sensitive information via the Web site, the information is protected both online and off-line. All of our users' information, not just the sensitive information mentioned above, is restricted in our offices. Only employees who need the information to perform a specific job (for example, a billing clerk or customer service representative) are granted access to personally identifiable information. Our employees must use password-protected screen-savers when they leave their desk. When they return, they must re-enter their password to re-gain access to user information. Furthermore, ALL employees are kept up-to-date on our security and privacy practices. Every quarter, as well as any time new policies are added, our employees are notified and/or reminded about the importance we place on privacy, and what they can do to ensure our customers' information is protected. Finally, the servers that we store personally identifiable information on are kept in a secure environment, behind a locked cage.     Special Offers

    We send all new members a welcoming email to verify password and username. Established members will occasionally receive information on products, services, special deals, and a newsletter. Out of respect for the privacy of our users we present the option to not receive these types of communications. Please see description of our choice/opt-out policy below.

     

    Website Activity

    MPTours S.A. uses a third party tracking utility to track end-user activity through our site through the use of cookies. Activity is tracked in an effort to make our site easy to navigate through, and to find out which areas of our site draw the most attention. The information tracked are such things as Most Requested Page, Least Requested Page, Top Entry Page, Top Path Through Site, cities users are visiting from, average length of time spent at the site, etc.

     

    Correcting/Updating Personal Information

    If a user's personally identifiable information changes (such as zip code) we will endeavor to provide a way to correct, update, or remove that user's personal data. Email Customer Support at info@mptours.com. You will receive a response to your request within twenty (20) business days.

     

    Notification of Changes

    If we decide to change our privacy policy, we will post those changes on our Homepage so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. If at any point we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we will notify users by email. Users will have a choice as to whether or not we use their information in this different manner. We will use information in accordance with the privacy policy under which the information was collected.

     

    Legal Obligations

    MPTours S.A. provides its service to you subject to the following Terms and Conditions of Use Agreement. Please read this agreement carefully!

     

    This agreement (the "Agreement") governs your use of the www.mptours.com website (the ?Service?), as provided by MPTours S.A. As used in this Agreement, "we", "us", or "our" refers to MPTours S.A., the shareholders of MPTours S.A., and "you" or your" refers to the company or person(s) who uses the Service. The Agreement also governs your use of any data you obtain by using the Service.

     

    MPTours S.A. grants to you a non-exclusive right during the term of this Agreement to use the Service pursuant to the terms and conditions set out herein. Your use of the Service confers no title or ownership in the Service. All ownership rights remain with MPTours S.A.

     

    01.       SERVICES AND SUPPORT

     

    1.1.  MPTours S.A. offers its Service on an "as is" basis subject to the terms set forth in this Agreement. MPTours S.A. may, at any time, modify the terms and conditions of this Agreement and may discontinue or revise any or all other aspects of the Service at its sole discretion. Any such modifications will be made available online and will be effective immediately upon posting to MPTours S.A.'s hosted website. You agree to assume responsibility for periodically reviewing this Agreement. By continuing to use the service, following the initial posting date of modifications made by MPTours S.A., you also agree to be bound by the Agreement as amended. If at any time, you disagree with the terms and conditions of this Agreement, you may terminate this Agreement as provided below.

     

    02.       RESTRICTIONS AND RESPONSIBILITIES

     

    2.1. This is an Agreement for Service, and you are not granted a license to any software by this Agreement. You will not, directly or indirectly: reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, object code, or underlying structure, ideas, or algorithms of, or found at or through the Service or any software, documentation, or data related to the Service ("Software"); remove any proprietary notices or labels from the Service or any Software; modify, translate, or create derivative works based on the Service or any Software; or copy, distribute, pledge, assign, or otherwise transfer or encumber rights to the Service or any Software.

     

    2.2. You will abide by our privacy policy as set forth on our home page. We may update these documents from time to time at our sole discretion.

     

    2.3. You agree to indemnify, defend and hold harmless MPTours S.A., its subsidiaries, affiliates, officers, employees, and consultants from any and all claims, liability, damages and/or costs (including without limitation legal fees) arising from your use of the Service, or from your violation of the terms of this Agreement.

     

    2.4. We will not use any customer information for any other purposes than those intended with the service. In addition, we will not use your customer information for the purpose of sending unsolicited commercial email. We will not disclose personally identifiable information about you to third parties, without your authorization, unless we believe such disclosure is reasonably necessary to: (1) comply with the law or legal process; (2) protect or defend our rights or property or that of others; (3) enforce this Agreement; (4) respond to claims that the contents of any communications violate the rights of others; or (5) as otherwise provided in the Agreement.

     

    2.6. The Service may only be used for lawful purposes. Transmission or solicitation of any material that violates the applicable laws of United States of America, Uruguay, Argentina or other laws that may apply in your local area is prohibited. This may include material that is obscene, threatening, harassing, libelous, or in any way a violation of intellectual property laws or a third party's intellectual property rights.

     

    2.7. We reserve the right, but are not obligated to, review and approve any content posted by Users. We retain the right to cancel and delete any information/content violating responsible usage rules as defined by MPTours S.A.. We disclaim all copyright and other rights in such content and all responsibility for them.

     

    2.8. You will also indemnify us in the event that MPTours S.A. shares your name with third parties for violations of usage rules. By using the Service, you are giving MPTours S.A. permission to copy and/or store user content, contact lists and other information.

     

    2.9. We will not use your content or other information for any purpose that violates our privacy policy.

     

    03.       TERMINATION

     

    3.1. You may terminate this Contract at any time by (i) contacting us via email to info@mptours.com; or (ii) sending written notice to: MPTours S.A.

     

    3.2. This Agreement may be terminated at any time: i) immediately by either party to the other if the other commits any material breach of any these conditions and which (in the case of a breach capable of being remedied) has not been remedied within a reasonable time period as may be specified in a formal request in writing or by email to remedy the same; or ii) immediately by written notice from MPTours S.A. if you commit any material breach of any these conditions that may impact our Service or servers or our ability to provide the Service.

     

    04.       DISCLAIMER OF WARRANTIES

     

    4.1. The Service is provided on an "as is" and "as available" basis. You use the Service at your own risk. To the fullest extent permissible pursuant to applicable law, we disclaim all warranties of any kind, whether express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose or non-infringement. We do not make any warranty that the Service will meet your requirements, or that the Service will be uninterrupted, timely, secure, or error free, or that defects, if any, will be corrected; nor do we make any warranty as to the results that may be obtained from the use of the Service or as to the accuracy or reliability of any information obtained through use of the Service.

     

    4.2. You understand and agree that any material and/or data downloaded or otherwise obtained through the use of the Service is at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of such material and/or data.

You agree that it is your responsibility to install anti-virus software and related protections against viruses, trojan horses, worms, time bombs, cancelbots or other computer programming routines or engines that are intended to damage, destroy, disrupt or otherwise impair a computer's functionality or operation which may be transferred to your computer via the Service.

    05.       LIMITATION OF LIABILITY

Under no circumstances, including but without limitation, shall MPTours S.A. or its shareholders, subsidiaries, affiliates, officers, directors, employees, agents, or suppliers be liable for any direct, indirect, incidental, special or consequential damages, resulting from the use or the inability to use the Service or for the cost of procurement of substitute goods and services or messages received or transactions entered into by means of or through the Service, or other information that is sent or received or not sent or received, including but not limited to, damages for loss of profits, use, data or other intangibles, even if we have been advised of the possibility of such damages. If you are dissatisfied with the Service, your exclusive remedy is to discontinue use of the Service. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages so some of the above may not apply to you. Without limiting any of the foregoing, we are not responsible for any of your materials and data residing on our network hardware. You are responsible for backing-up your materials and data that may reside on our network hardware, whether or not such materials and data are produced through the use of the Service. It is your responsibility to take the necessary steps to ensure your primary means of business is maintained.

     

    5.2. We reserve the right to access and disclose individually identifiable information to comply with applicable laws and lawful government requests, to operate its systems properly or to protect itself or its users.

MPTours S.A., MPTours, MPTours.com and all other names, images, pictures, logos and icons identifying us or our services are trademarks of MPTours S.A. in the United States of America, Uruguay, Argentina and other countries. Other product and company names mentioned on this website may be trademarks of their respective owners.

     

    07.       TERM OF THE AGREEMENT

     

    7.1. The term of this Agreement will begin upon your first use of the Service and will end when terminated by either you or us as described herein. We may terminate this Agreement at any time, with or without cause, and with or without notice. In the event that you would like to terminate this Agreement, you will need to send such notice of termination via email to info@mptours.com. Your termination of the Agreement will be effective upon the last day of the month in which we received such notification.

     

    08.       CONTENT DELIVERY

     

    8.1. Delivery of MPTours Content. All MPTours Content will be delivered electronically to the Customer via download from www.mptours.com after acceptance of payment.

     

    8.2. Availability of MPTours Content. We will exercise reasonable efforts to provide the MPTours Content in a timely manner. On occasion, technical or supplier problems may delay or prevent delivery.

     

    8.3. MPTours Refund Policy. No refund request will be accepted. All payments and transactions made on www.mptours.com are final and not refundable.
